1. About These Terms
These terms govern your use of Bloom (“the Platform”), a practice management platform for UK financial advisers operated by Arthur Browns Wealth Management Ltd (FCA 825843) (“we”, “us”, “our”).
By creating an account or using Bloom, you agree to these terms. If you do not agree, please do not use the Platform.
2. Eligibility
Bloom is designed for FCA-authorised financial advisers and their support staff in the United Kingdom. By registering, you confirm that you are acting in a professional capacity and are authorised (or employed by a firm that is authorised) by the Financial Conduct Authority.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials
- You must not share your account with unauthorised individuals
- You are responsible for all activity under your account
- You must notify us immediately if you suspect unauthorised access
4. Acceptable Use
You agree to:
- Use Bloom only for lawful purposes related to financial advice practice management
- Ensure all client data you enter is accurate and that you have a lawful basis to process it
- Comply with all applicable laws, including UK GDPR, the Data Protection Act 2018, and FCA rules
- Not attempt to access other users' data or systems
- Not reverse engineer, decompile, or attempt to extract the source code of the Platform
5. Data Responsibility
As a financial adviser, you are the data controller for any client data you enter into Bloom. We act as your data processor. You are responsible for:
- Having a lawful basis to process your clients' personal data
- Informing your clients that their data is stored in Bloom
- Responding to Subject Access Requests from your clients
- Ensuring the accuracy of the data you enter
See our Privacy Policy for full details on how we handle data.
6. AI Features
Bloom includes AI-powered features (including Bloom AI, meeting transcription, and fact extraction). These features are tools to assist you — they do not constitute financial advice. You are responsible for reviewing and verifying all AI-generated output before relying on it in any client-facing context.
7. Subscription and Pricing
- Bloom is currently in early access and free to use
- When pricing is introduced, we will give at least 30 days' notice
- Admin and paraplanner seats are always free — only adviser seats are charged
- You may cancel your subscription at any time
8. Availability and Support
We aim to keep Bloom available 24/7 but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice of planned downtime where possible.
9. Intellectual Property
All intellectual property in the Platform (including design, code, and branding) belongs to us. Your data remains yours — we do not claim ownership of any data you enter into Bloom.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of Bloom. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Bloom is a practice management tool, not a regulated advice service. We do not provide financial advice and accept no liability for advice decisions made using the Platform.
11. Termination
Either party may terminate this agreement at any time. On termination, you may request an export of your data. We will retain data as required by FCA regulations and delete all other data within 90 days.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
